Terms of Service | Samaan

1. Acceptance of Terms

By accessing or using the Samaan platform (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Samaan is a product of Samaan Technologies (Pvt.) Ltd., registered in Pakistan.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract. By registering as a Dukaandar or Supplier, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify Samaan immediately of any unauthorized use. Samaan cannot be held liable for loss or damage arising from your failure to secure your account.

4. Platform Use

Samaan connects Dukaandars (retailers) with Suppliers (brands & distributors). We do not take title to goods sold through the platform. All transactions are between the buyer and seller directly. Samaan is not a party to any transaction and disclaims all liability arising from disputes between users.

5. Payments & Pricing

All prices displayed on Samaan are set by the Supplier. Samaan may charge a platform fee or commission, which will be clearly disclosed before you complete any transaction. Payment terms, delivery timelines, and return policies are agreed upon between buyer and seller.

6. Prohibited Conduct

You agree not to: (a) use the platform for any unlawful purpose; (b) upload false or misleading product listings; (c) interfere with the platform's operation; (d) scrape or data-mine without permission; (e) harass or defraud other users.

7. Intellectual Property

The Samaan name, logo, platform design, and all related branding are the exclusive property of Samaan Technologies (Pvt.) Ltd. You may not use our marks without prior written consent. Content you upload remains yours; you grant Samaan a license to display it on the platform.

8. Limitation of Liability

To the fullest extent permitted by Pakistani law, Samaan shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability in any matter is limited to the fees you paid us in the 12 months preceding the claim.

9. Termination

Samaan reserves the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any conduct that harms the platform or its users. You may delete your account at any time through your account settings.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the platform after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of courts in Karachi.
